Terms of Service

1. Agreement to Terms

By accessing or using Flow ("the Service"), operated by Abhishek Paul (a GST-registered sole proprietorship based in Birbhum, West Bengal, India), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of https://flow.happen-ai.com.

2. Description of Service

Flow is an Instagram comment-to-DM automation platform. It allows users with Instagram Business accounts to automatically reply to comments on their posts and send direct messages to commenters based on configurable rules, using the official Meta Graph API.

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. Eligibility

To use Flow, you must:

• Be at least 18 years of age.
• Have a valid Facebook account and an Instagram Business or Creator account.
• Have the legal authority to bind yourself (or your organization) to these Terms.
• Comply with Meta's Terms of Service and Community Standards.

4. User Responsibilities

By using the Service, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
• Comply with Meta's Platform Policies, Instagram's Community Guidelines, and any other applicable third-party terms.
• Not use the Service to send spam, unsolicited commercial messages, or harassing content.
• Not use the Service to impersonate any person or entity.
• Not attempt to circumvent any rate limits or usage restrictions imposed by Meta or by Flow.
• Not use the Service to collect personal data from other users without their consent.
• Take full responsibility for all content sent via automations you configure.
• Keep your account credentials secure and notify us immediately of any unauthorized access.

5. Prohibited Uses

You may not use Flow to:

• Violate any local, national, or international law or regulation.
• Transmit any material that is defamatory, offensive, or otherwise objectionable.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use any automated means to access the Service beyond the intended API integration.

6. Intellectual Property

All intellectual property rights in the Service, including software, design, logos, and content (excluding your own content), are owned by or licensed to Abhishek Paul. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.

You retain ownership of all content you create and the automation configurations you set up. You grant us a limited license to use that content solely to provide the Service.

7. Third-Party Services

Flow integrates with Meta's platforms (Facebook and Instagram) via their official APIs. Your use of Meta's services is subject to Meta's own Terms of Service. We are not responsible for changes to Meta's APIs, policies, or availability that may affect the Service.

If Meta suspends or restricts your account, or revokes our API access, we cannot guarantee continued functionality of your automations.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant that your automations will always execute successfully, as this depends on third-party API availability (Meta) and your account standing.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ABHISHEK PAUL OR FLOW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED INDIAN RUPEES (INR 100).

10. Indemnification

You agree to indemnify and hold harmless Abhishek Paul and Flow from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) content sent via your automations.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Reasons may include, but are not limited to, violation of these Terms, misuse of the Service, or requests from law enforcement.

You may terminate your account at any time by revoking Flow's access via Facebook App Settings and contacting us to delete your data.

Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, 12, and 13 survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in West Bengal, India.

Before filing any legal claim, you agree to first contact us at abhishekpaul0055@gmail.com and attempt to resolve the dispute informally for at least 30 days.

13. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
